Law Simplified – The Transfer of Property Act, 1882 redrafted in a simple, lucid language.
Let’s face it – the Transfer of Property Act, or the TPA, is quite a nastily drafted piece of legislation.
The language is contemptuously tough. The sentences are obscenely long. It takes more time to make sense of the language than the law itself.
Time that could have been used to understand the law and not the language of the law.
During law school, I avoided studying this law in depth even though we were told that TPA is a major law in civil practice.
Friends preparing for the judicial services had to read, re-read and re-re-read the Act just to make sense of the language.
At the Bar, I have seen Lawyers having sticky notes pasted in the Bare Act – with certain provisions re-written in a simplified language.
And let’s admit it – the Act was drafted by the British, FOR the British.
It was either not drafted to be understood by us, or it was drafted to be NOT understood by us.
Did you get what I wrote above? This is exactly how the Act is written.
Let me re-write it the way I redrafted the Act -
Either it was not written in a way that we can understand, or it was intentionally written so that we cannot understand it.
So, the solution?
To rewrite the entire law from scratch, in a language that does not require you to bang your head against the wall.
And that’s why, after spending 200+ hours of nerve-wracking work, I give you -
